Other Remedies to Tackle Anti-Social Behaviour
The Anti-Social Behaviour Act 2003 gave us new powers to deal with anti social behaviour. Different elements of the Act were brought into force during 2004.
Action Against Non Tenants - A new type of injunction can be taken out against those people that cause anti-social behaviour to our tenants in cases of persistent or serious behaviour.
Introductory Tenancies - Derby Homes introduced Introductory Tenancies on 1 May 2004. This means the majority of people who come to Derby Homes will be ‘Introductory Tenants’ for their first year. If incidents of anti-social behaviour occur during the first year, the action to take possession of the property through the County Court can be taken more quickly. An Introductory Tenancy becomes a secure tenancy after one year.
Demoted Tenancies - The introduction of ‘Demoted Tenancies’ also means that a tenant who is a secure tenant can have their tenancy reduced or ‘demoted’ to a tenancy that is less secure. This would be obtained through the County Court. A demoted tenancy lasts for one year.
