Abusive Resident Receives Anti Social Behaviour Injunction - August 2007

A nuisance resident has been served an Anti-Social Behaviour Injunction after repeatedly subjecting local residents in the square near Rothesay Close of Sinfin to harassment and intimidation.

Derby City Council successfully obtained the Anti Social Behaviour Injunction with a Power of Arrest and Exclusion Order (under Section 153A of the Housing Act 1996) against Jahvan Gibbons, of Littleover, in June of this year.

Whilst not a tenant of Derby Homes, Jahvan’s anti social behaviour took place in the Sinfin area where Derby Homes manage numerous properties.  It was a Derby Homes’ Neighbourhood Safety Officer that was instrumental in investigating the allegations and securing the injunction.

Jahvan was a member of a group of youths that regularly abused, spat at, and harassed residents as well as bullying young children and vulnerable adults.  The intimidation extended to those seeking to monitor neighbourhood safety when Jahvan and the other youths threw stones at a Community Watch patrol van in Sinfin.

Derby Homes received a large number of complaints from their tenants in addition to a petition containing 119 signatures.  A Community Safety Officer, employed by Derby Community Safety Partnership, reported witnessing the harassment of residents on several occasions.

The current Anti Social Behaviour Injunction, Power of Arrest and Exclusion Order will forbid Jahvan Gibbons from a number of activities including entering or being upon certain areas of Sinfin and threatening to engage in, or engaging in conduct, which is likely to cause a nuisance or annoyance to any person.

Jahvan could face committal to prison should he breach this Anti Social Behaviour Injunction.  The Derbyshire Constabulary are aware that the Injunction is in place and members of the public are urged to contact the Police should they witness Jahvan Gibbons causing anti-social behaviour.

Dennis Rees, Chair of Derby Homes’ Board, said: “This sends out a clear message to all tenants and residents that Derby City Council, in partnership with Derby Homes, will take action against those who cause anti social behaviour.”
